Freight Forwarders: Incorrect Declarations Will Result in Cargo Detention

The European Union's ICS2 Import Control System has entered a new compliance enforcement phase, with ocean carriers implementing stricter loading regulations. Maersk has announced that starting 30 September 2026, all sea freight destined for or transiting through EU territories will require a valid Movement Reference Number (MRN) under a strict "No MRN, No Loading" policy.

The MRN, an 18-digit identifier generated by EU customs upon acceptance of an Entry Summary Declaration (ENS), confirms customs approval. Without a valid MRN, cargo cannot be loaded. This rule applies to all shipments destined for EU member states or transiting EU ports. Declarations must be completed and approved 24 hours before port cut-off. Non-compliant cargo will be removed from loading lists, rolled over, or returned with no exceptions.

Under ICS2 regulations, ENS declarations can be rejected for vague commodity descriptions, incorrect HS codes, missing EORI numbers, incomplete addresses, or inconsistencies between the bill of lading and declared data. Customs authorities may issue a Do Not Load (DNL) instruction, preventing shipment loading. Non-compliant cargo arriving at EU ports will face detention, fines of up to EUR 5,000 per shipment, and heightened inspection rates for repeat offenders.

Broad commodity descriptions like "electronics" or "general cargo" are no longer accepted. Declarations must include detailed information on material composition, specifications, and intended use. Mixed-cargo shipments must use line-by-line declarations, and only standard 6-digit HS codes are valid.

The 30 September policy marks the final phase of ICS2 implementation. As of 1 June 2026, all ICS1 transitional exemptions have been retired, and mandatory ENS declarations now cover all modes of EU-bound transport. From 1 September 2026, Amazon's Pan-European Programme will also require non-EU sellers to attach valid MRNs to shipments, reinforcing upstream compliance.

Freight forwarders must act now to avoid rollovers, detention, and penalties. Review ENS templates, verify key data, and communicate deadlines with cargo owners to ensure error-free submissions. Systematic compliance and data verification are essential to navigating the new EU customs landscape effectively.
